A company is not allowed to discriminate against somebody with a disability but if your company is facing hard times and has to make a number of people redundant there is no specific reason why being off on long term sickness could specifically protect you . Does your company have a specific redundancy policy such as "Last In, First Out"?
my company does not have the last in first out policy, the thing is there is a large scale of redundancies ongoing, and someone is on the long term sick (again after just coming back after 6 months) what is being talked about is that he will be ok because he is on the sick,and therefore can not be affected... I find this unfair and would like to think he will be top of the list......not sure if that will happen.
Well for a kick-off, sickness is not a disability. However having a disability may lead to periods of absence for which employer should make allowances.
Absence (and note that I am using that word) causes problems for an employer because a person cannot do their job when they are absent.
So multiple absences are likely be one of the criteria used by an employer when assessing for redundancy.
Yes, people on the sick can be (and are) made redundant.
